Terms & Conditions

By registering, accessing, or using the Services (defined below) via the Cobot app mobile application or at our premises, you (“Member”, “you”, “your”) agree to be bound by these Terms and Conditions (“Agreement”).
1. Definitions
- “We”, “Us”, “Operator” means Share Space Phuket, the operator of the co-working space.
- “Services” means access to the co-working premises, desks, meeting rooms, Wi-Fi, printing, refreshments, events, and other facilities/amenities as described in your selected Membership Plan.
- “Membership Plan” means the plan you select and purchase via the App or in person (e.g., Day Pass, Weekly, Monthly, Annual).
- “Premises” means the co-working space located at The Rich Villa Subdistrict, 99/16, Ko Kaeo, Mueang Phuket District, Phuket 83000, Thailand.
2. Membership & Access
2.1 Membership is personal, non-transferable, and non-assignable unless otherwise stated.
2.2 Access depends on your Membership Plan:
- Day Pass / Casual: Limited to published operating hours.
- Monthly and higher tiers: As specified in your plan (may include 24/7 access for eligible plans).
2.3 We may require identity verification, a photo, and/or Thai visa/work-permit details for legal compliance.
2.4 We reserve the right to refuse or terminate membership at our sole discretion, subject to applicable Thai consumer protection laws.
2.5 You must use the Premises only for lawful activities you are legally entitled to perform. We are not responsible for any legal violations on your part.
2.6 Membership is available to individuals aged 16 and over, subject to these terms.
3. Fees & Payment
3.1 All fees are in Thai Baht (THB) and inclusive of VAT unless stated otherwise.
3.2 Payment is due in advance via the App (credit/debit card, bank transfer, or other available methods).
3.3 Monthly memberships auto-renew unless cancelled with at least 14 days' notice (see Clause 9).
3.4 Late payments incur a 50 THB penalty per day. Membership may be cancelled if payment is more than 14 days late.
3.5 We may adjust fees with 30 days' notice via the App or email. Significant changes require your acceptance to continue membership.
4. Use of the Premises & House Rules
4.1 You agree to:
- Use the Premises solely for lawful professional, business, study, or quiet purposes.
- Keep your workstation clean and tidy.
- Not move furniture without permission.
- Respect quiet/working zones: No speakerphone calls; use headphones for video calls or book a meeting room.
- Not bring pets (except certified service animals).
- Not engage in illegal, offensive, or disruptive behavior.
- Not conduct retail, massage, or non-office activities.
- Not store hazardous materials.
- Not eat hot or smelly food inside the Premises. Cold snacks are permitted at desks or in the pantry; tidy up and dispose of waste properly.
- Not consume alcohol during operating hours.
- Use our partner F&B services via Front of House where available.
- No children under 16 during operating hours.
- We may host events during lunch hours or after 5pm.
4.2 Prohibited conduct includes (but is not limited to):
- Sleeping overnight.
- Excessive alcohol consumption.
- Smoking or vaping indoors.
- Filming or photographing other members without consent.
4.3 We enforce a zero-tolerance policy for harassment, discrimination, violence, or illegal activity.
5. Booking of Meeting Rooms & Additional Services
5.1 Meeting rooms must be booked via the App.
5.2 Unused bookings may incur cancellation or no-show fees as shown in the App.
5.3 Additional services (e.g., printing, events) may incur separate fees.
6. Health, Safety & Security
6.1 You must follow all safety instructions, fire regulations, and emergency procedures.
6.2 We may perform security checks and use CCTV monitoring in compliance with the Thai Personal Data Protection Act B.E. 2562 (PDPA).
6.3 You are responsible for securing your belongings. We are not liable for loss, theft, or damage to personal property (see Clause 8).
7. Intellectual Property & Confidentiality
7.1 You retain ownership of your own intellectual property.
7.2 You must not disclose or misuse any confidential information of other Members encountered at the Premises.
7.3 We may use anonymized photos/videos of common areas or events for marketing.
8. Liability & Indemnity
8.1 Services are provided “as is.” We do not guarantee uninterrupted access, specific Wi-Fi speeds, or availability of desks/meeting rooms.
8.2 To the maximum extent permitted by law, our total liability is limited to the fees you paid in the preceding month.
8.3 We are not liable for indirect, consequential, special damages, business interruption, or loss of data/profits.
8.4 You indemnify us against claims arising from your breach of this Agreement, your acts/omissions, or violations of law.
9. Termination & Cancellation
9.1 By You:
- Day/Weekly passes: Non-refundable.
- Monthly+: Cancel with 14 days' written notice via App/email (effect depends on plan).
- Annual: Transferable once per 12-month period; non-refundable.
9.2 By Us:
- Immediate termination for serious breach (e.g., non-payment >14 days, prohibited conduct, illegal activity).
- 14 days' notice for convenience or operational reasons.
9.3 On termination, vacate immediately, return access cards/keys, and pay all outstanding amounts.
10. Force Majeure
We are not liable for failure to perform due to events beyond our reasonable control (e.g., natural disasters, government orders, pandemics, power outages).
11. Governing Law & Dispute Resolution
11.1 This Agreement is governed by the laws of the Kingdom of Thailand.
11.2 Disputes fall under the exclusive jurisdiction of the courts in Phuket, Thailand.
11.3 We encourage informal resolution first.
12. Amendments
We may update these Terms. Continued use after changes are posted constitutes acceptance. Significant changes will be notified via the App.
13. Miscellaneous
13.1 If any provision is invalid, the remainder remains enforceable.
13.2 No waiver of one breach waives future breaches.
13.3 This Agreement is the entire understanding between you and us.

เมื่อคุณลงทะเบียน เข้าถึง หรือใช้บริการ (ตามที่กำหนดไว้ด้านล่าง) ผ่านแอปพลิเคชันมือถือ [ชื่อแอป] หรือที่สถานที่ของเรา คุณ (“สมาชิก” “คุณ” “ของท่าน”) ตกลงยอมรับและผูกพันตามข้อกำหนดและเงื่อนไขเหล่านี้ (“สัญญา”)
1. คำจำกัดความ
- “เรา” “พวกเรา” “ผู้ดำเนินการ” หมายถึง Share Space Phuket ผู้ดำเนินการพื้นที่ทำงานร่วมกัน
- “บริการ” หมายถึง การเข้าถึงสถานที่ทำงานร่วมกัน โต๊ะทำงาน ห้องประชุม Wi-Fi การพิมพ์ เครื่องดื่ม กิจกรรม และสิ่งอำนวยความสะดวกอื่น ๆ ตามที่ระบุในแผนสมาชิกที่คุณเลือก
- “แผนสมาชิก” หมายถึง แผนที่คุณเลือกและชำระเงินผ่านแอปหรือ ณ สถานที่ (เช่น Day Pass, รายสัปดาห์, รายเดือน, รายปี)
- “สถานที่” หมายถึง พื้นที่ทำงานร่วมกัน ตั้งอยู่ที่ ตำบลโคกแก้ว 99/16 เกาะแก้ว อำเภอเมืองภูเก็ต จังหวัดภูเก็ต 83000 ประเทศไทย
2. สมาชิกภาพและการเข้าถึง
2.1 สมาชิกภาพเป็นสิทธิส่วนบุคคล ไม่สามารถโอนสิทธิหรือมอบหมายต่อได้ เว้นแต่ได้รับอนุญาตเป็นลายลักษณ์อักษรล่วงหน้าจากเรา
2.2 การเข้าถึงขึ้นอยู่กับแผนสมาชิกของคุณ:
- Day Pass / Casual: เฉพาะช่วงเวลาทำการที่ประกาศไว้
- รายเดือนและระดับสูงกว่า: ตามที่ระบุในแผน (อาจรวมถึงการเข้าถึง 24/7 สำหรับแผนที่เข้าเกณฑ์)
2.3 เราอาจกำหนดให้มีการตรวจสอบตัวตน ถ่ายภาพ และ/หรือข้อมูลวีซ่า/ใบอนุญาตทำงานของไทย เพื่อการปฏิบัติตามกฎหมาย
2.4 เราขอสงวนสิทธิ์ในการปฏิเสธหรือยกเลิกสมาชิกภาพตามดุลยพินิจของเรา โดยอยู่ภายใต้กฎหมายคุ้มครองผู้บริโภคของไทยที่เกี่ยวข้อง
2.5 คุณต้องใช้สถานที่เพื่อวัตถุประสงค์ที่ถูกกฎหมายเท่านั้น ซึ่งคุณมีสิทธิ์กระทำได้ตามกฎหมาย เราจะไม่รับผิดชอบต่อการฝ่าฝืนกฎหมายใด ๆ ของคุณ
2.6 สมาชิกภาพเปิดให้บุคคลอายุ 16 ปีขึ้นไป ภายใต้เงื่อนไขของสัญญานี้
3. ค่าธรรมเนียมและการชำระเงิน
3.1 ค่าธรรมเนียมทั้งหมดเป็นเงินบาทไทย (THB) และรวมภาษีมูลค่าเพิ่มแล้ว เว้นแต่ระบุเป็นอย่างอื่น
3.2 การชำระเงินต้องชำระล่วงหน้าผ่านแอป (บัตรเครดิต/เดบิต โอนเงินธนาคาร หรือวิธีอื่นที่รองรับ)
3.3 สมาชิกภาพรายเดือนจะต่ออายุอัตโนมัติ เว้นแต่จะยกเลิกโดยแจ้งล่วงหน้าอย่างน้อย 14 วัน (ดูข้อ 9)
3.4 การชำระเงินล่าช้าจะมีค่าปรับ 2% ต่อเดือน หากค้างชำระเกิน 1 เดือน เราอาจยกเลิกสมาชิกภาพ
3.5 เราอาจปรับค่าธรรมเนียมโดยแจ้งล่วงหน้า 30 วัน ผ่านแอปหรืออีเมล การเปลี่ยนแปลงที่สำคัญต้องได้รับการยอมรับจากคุณเพื่อดำเนินการสมาชิกภาพต่อไป
4. การใช้สถานที่และกฎระเบียบภายใน
4.1 คุณตกลงที่จะ:
- ใช้สถานที่เพื่อวัตถุประสงค์ทางวิชาชีพ ธุรกิจ การศึกษา หรือกิจกรรมเงียบสงบที่ถูกกฎหมายเท่านั้น
- รักษาความสะอาดและเป็นระเบียบเรียบร้อยที่โต๊ะทำงานของตน
- ไม่เคลื่อนย้ายเฟอร์นิเจอร์โดยไม่ได้รับอนุญาต
- เคารพโซนเงียบ/ทำงาน: ห้ามใช้ลำโพงโทรศัพท์ ต้องใช้หูฟังสำหรับวิดีโอคอล หรือจองห้องประชุม
- ไม่นำสัตว์เลี้ยงเข้ามา (ยกเว้นสัตว์ช่วยเหลือที่ได้รับการรับรอง)
- ไม่กระทำการที่ผิดกฎหมาย ล่วงละเมิด หรือรบกวนผู้อื่น
- ไม่ดำเนินกิจกรรมค้าปลีก นวด หรือกิจกรรมที่ไม่ใช่งานสำนักงาน
- ไม่เก็บวัสดุอันตราย
- ห้ามบริโภคอาหารร้อนหรือมีกลิ่นแรงภายในสถานที่ อนุญาตให้รับประทานอาหารเย็นและของว่างที่โต๊ะหรือบริเวณ pantry โดยต้องทำความสะอาดและทิ้งขยะให้เรียบร้อย
- ห้ามดื่มแอลกอฮอล์ในช่วงเวลาทำการ
- ใช้บริการอาหารและเครื่องดื่มจากพันธมิตรผ่าน Front of House
- ห้ามนำเด็กอายุต่ำกว่า 16 ปีเข้ามาในช่วงเวลาทำการ
- เราอาจจัดกิจกรรมในช่วงเวลากลางวัน (ช่วงพักเที่ยง) หรือหลัง 17:00 น.
4.2 พฤติกรรมต้องห้าม ได้แก่ (แต่ไม่จำกัดเพียง):
- นอนค้างคืน
- ดื่มแอลกอฮอล์มากเกินไป
- สูบบุหรี่หรือ vaping ภายในสถานที่
- ถ่ายภาพหรือบันทึกวิดีโอสมาชิกอื่นโดยไม่ได้รับความยินยอม
4.3 เรามีนโยบายไม่ยอมรับการล่วงละเมิด การเลือกปฏิบัติ ความรุนแรง หรือกิจกรรมผิดกฎหมายโดยเด็ดขาด
5. การจองห้องประชุมและบริการเสริม
5.1 การจองห้องประชุมต้องทำผ่านแอป
5.2 การจองที่ไม่ได้ใช้งานอาจมีค่าธรรมเนียมยกเลิกหรือไม่มาใช้ตามที่แสดงในแอป
5.3 บริการเสริม (เช่น การพิมพ์ กิจกรรม) อาจมีค่าธรรมเนียมแยกต่างหาก
6. สุขภาพ ความปลอดภัย และความมั่นคง
6.1 คุณต้องปฏิบัติตามคำแนะนำด้านความปลอดภัย กฎระเบียบดับเพลิง และขั้นตอนฉุกเฉินทั้งหมด
6.2 เราอาจตรวจสอบความปลอดภัยและใช้กล้องวงจรปิด โดยปฏิบัติตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (PDPA)
6.3 คุณรับผิดชอบดูแลทรัพย์สินของตนเอง เราไม่รับผิดชอบต่อการสูญหาย ถูกขโมย หรือเสียหายของทรัพย์สินส่วนบุคคล (ดูข้อ 8)
7. ทรัพย์สินทางปัญญาและความลับ
7.1 คุณยังคงเป็นเจ้าของทรัพย์สินทางปัญญาของตนเอง
7.2 คุณต้องไม่เปิดเผยหรือนำข้อมูลลับของสมาชิกอื่นที่ทราบจากการใช้สถานที่ไปใช้ในทางที่มิชอบ
7.3 เราอาจใช้ภาพถ่าย/วิดีโอแบบไม่ระบุตัวตนของพื้นที่ส่วนกลางหรือกิจกรรมเพื่อการตลาด
8. ความรับผิดและการชดใช้ค่าเสียหาย
8.1 บริการให้บริการตามสภาพที่เป็น (“as is”) เราไม่รับประกันการเข้าถึงอย่างต่อเนื่อง ความเร็ว Wi-Fi ที่แน่นอน หรือความพร้อมของโต๊ะ/ห้องประชุม
8.2 เท่าที่กฎหมายอนุญาต ความรับผิดทั้งหมดของเราจะไม่เกินค่าธรรมเนียมที่คุณชำระในช่วง 1 เดือนก่อนหน้า
8.3 เราไม่รับผิดชอบต่อความเสียหายทางอ้อม ผลสืบเนื่อง พิเศษ การหยุดชะงักทางธุรกิจ หรือการสูญเสียข้อมูล/กำไร
8.4 คุณตกลงชดใช้ค่าเสียหายแก่เรา จากการเรียกร้องใด ๆ ที่เกิดจากการฝ่าฝืนสัญญา การกระทำ/ละเว้น หรือการฝ่าฝืนกฎหมายของคุณ
9. การยกเลิกและการสิ้นสุด
9.1 โดยคุณ:
- Day/Weekly: ไม่คืนเงิน
- รายเดือน+: แจ้งยกเลิกเป็นลายลักษณ์อักษรผ่านแอป/อีเมลล่วงหน้า 14 วัน (ผลตามแผน)
- รายปี: โอนสิทธิ์ได้ 1 ครั้งต่อรอบ 12 เดือน ไม่คืนเงิน
9.2 โดยเรา:
- ยกเลิกทันที หากมีการฝ่าฝืนร้ายแรง (เช่น ค้างชำระเกิน 14 วัน พฤติกรรมต้องห้าม กิจกรรมผิดกฎหมาย)
- แจ้งล่วงหน้า 14 วัน เพื่อความสะดวกหรือเหตุผลด้านการดำเนินงาน
9.3 เมื่อสิ้นสุดสัญญา คุณต้องออกจากสถานที่ทันที คืนบัตร/กุญแจ และชำระยอดค้างทั้งหมด
10. เหตุสุดวิสัย (Force Majeure)
เราไม่รับผิดชอบต่อการไม่สามารถปฏิบัติตามสัญญาได้อันเนื่องมาจากเหตุการณ์นอกเหนือการควบคุมที่สมเหตุสมผล (เช่น ภัยธรรมชาติ คำสั่งรัฐบาล การระบาดใหญ่ ไฟฟ้าดับ ฯลฯ)
11. กฎหมายที่ใช้บังคับและการระงับข้อพิพาท
11.1 สัญญานี้อยู่ภายใต้บังคับแห่งกฎหมายแห่งราชอาณาจักรไทย
11.2 ข้อพิพาทใด ๆ อยู่ภายใต้เขตอำนาจศาลของศาลในจังหวัดภูเก็ต ประเทศไทยโดยเฉพาะ
11.3 เราสนับสนุนการระงับข้อพิพาทโดยวิธีไม่เป็นทางการก่อน
12. การแก้ไข
เราอาจปรับปรุงข้อกำหนดและเงื่อนไขนี้ได้ การใช้บริการต่อเนื่องหลังจากการประกาศเปลี่ยนแปลง ถือเป็นการยอมรับ การเปลี่ยนแปลงสำคัญจะแจ้งผ่านแอป
13. มาตราเบ็ดเตล็ด
13.1 หากข้อใดในสัญญานี้เป็นโมฆะ ข้ออื่น ๆ ยังคงมีผลบังคับใช้
13.2 การไม่ใช้สิทธิในครั้งหนึ่ง ไม่ถือเป็นการสละสิทธิในครั้งต่อไป
13.3 สัญญานี้เป็นความเข้าใจทั้งหมดระหว่างคุณและเรา
เมื่อกด “ยอมรับ” / เสร็จสิ้นการลงทะเบียนในแอป คุณยืนยันว่าอ่าน เข้าใจ และตกลงยอมรับข้อกำหนดและเงื่อนไขเหล่านี้
